EPO Terms &
Conditions of Sale
Electronic Projects Online (referred to as EPO)
reserves the right to add to, amend or vary the terms and conditions,
by appending additions, variations or modifications to a quotation or
to any written correspondence with the customer.
Quotations do not constitute an offer and shall not
bind EPO until an order has been placed and accepted.
Verbal, telephoned or telegraphic
orders and any variations to orders must be confirmed in writing by
the Buyer, otherwise the Seller accepts no responsibility for errors
or subsequent misunderstandings.
Catalogues, price lists or other advertisement matter
are only an indication of the type of goods and no price or other
descriptive phrase shall bind EPO. Only EPO’s advertised prices at
www.electronicprojectsonline.co.uk or
http://stores.ebay.co.uk/Electronic-Projects-Online shall be valid
at the time of sale, unless specifically agreed
by written quotation.
All information given in terms of price lists,
catalogues or flyers distributed by EPO is given in good faith;
however, whilst every effort has been made to ensure that the
information is correct, EPO will not accept any responsibility for
errors which may have inadvertently been made.
All prices quoted on any document or correspondence
issued by EPO will currently include ‘Value Added Tax’.
EPO will
endeavour to
complete the contract or deliver the goods within the time agreed (if any) but will not be liable for any loss or damage of
any kind whatsoever caused directly or indirectly by any delay in the
completion of any contract or delivery of the goods.
If the delivery of goods are delayed or prevented for
any cause whatsoever beyond the Seller’s reasonable control then at
the discretion of EPO the unperformed part of the contract may be
cancelled or time for delivery extended. Such cancellations shall not
apply to completed parts of an order.
All claims for damage during transit, loss or items
missing must be submitted to EPO within three days of delivery. In the
case of non delivery of the whole consignment, claims must be
submitted in writing to EPO within seven days of receipt of
notification of dispatch of the goods. In absence of claims within
these time limits, the goods shall be deemed to have been properly
delivered.
The buyer shall purchase items with full knowledge of
the condition and suitability of the goods. Such goods however will be
of merchantable quality unless otherwise specified by EPO. Any
technical co-operation between EPO and the buyer will not affect this
condition.
EPO shall be under no liability for any failure on the
part of the buyer to comply in all respects with relevant safety
precautions and requirements of all relevant government, statutory or
other authorities, bodies or corporations relating to the goods and to
the applications to which the goods are put.
The buyer shall indemnify EPO against any cost claims
or demands which may be incurred by EPO as a result of such failure on
the part of the buyer.
EPO shall not be liable for any consequential or
indirect loss suffered by the buyer whether this loss arises from
breach of duty in contract or tort or in any other way (including loss
arising from the Seller’s negligence). Some non-exhaustive
illustrations of indirect loss would be:-
The buyer accepts that it is their responsibility to
insure against these risks.
In the event that the buyer objects to these terms and
conditions, objections must be brought to the attention of EPO before
conclusion of any contract so that (which shall at EPO’s entire
discretion) EPO may consider modify these terms. Appropriate increases
in the price of goods supplied under such terms may be agreed to reflect any increases, risks or obligation which EPO
may thus agree to bear.
Goods that are found to be DOA, sent in error or not
fit for purpose must be reported within 7 days of receipt. Integrated
circuits and other electronic components that may be subject to damage
by static electricity are excluded.
The buyer may return goods (at their own cost) that
are not deemed to be faulty and are fit for purpose subject to a 20%
handling and restocking charge. The buyer must notify EPO within 30
days of purchasing such items and the return will be at the discretion
of EPO. All items must be in their original packaging, be unused and
of a resalable condition.
All contracts with the Seller shall be deemed to have
been made in
England
and shall in all respects be construed and operate in accordance with
English law.
*Other manufacturer’s names, products and part numbers
may be used in material supplied by EPO. EPO does not claim that these
brand names, products or part numbers are their own.
